Former NFL coach Jon Gruden loses Nevada high court ruling in NFL emails lawsuit | AP News

Since his firing in 2021, former head coach of the Las Vegas Raiders Jon Gruden has been involved in a lawsuit against the NFL. Gruden said that racist emails were deliberately leaked by the league and Commissioner Roger Goodell to remove him from his position as Raiders coach.

However, the NFL claimed that Gruden’s contract as the Raiders coach precluded him from suing the league; as a result, a Nevada judge decided in the NFL’s favor, requiring arbitration between the parties, via ESPN News Services:

On Tuesday, a three-judge bench of the Nevada Supreme Court sided with the NFL against former coach Jon Gruden of the Las Vegas Raiders, ruling that he was not authorized to sue the league for his 2021 termination because he was still subject to arbitration as a former employee.

Elissa F. Cadish and Kristina Pickering, the justices, overturned a district court decision that had rejected the NFL’s attempt to compel Gruden’s case to be arbitrated. The lower court was ordered to approve the arbitration application and the matter was remanded.

The battle isn’t finished yet, though, as according to reports, Gruden’s lawyer plans to request a hearing before every justice on the Nevada Supreme Court:

The NFL has maintained that Gruden’s claim should be dismissed by the courts since his Raiders contract stipulated that he had to submit his claim through league arbitration.

Adam Hosmer-Henner, a lawyer for Gruden, contended that since his client is no longer employed by the NFL, arbitration—a procedure under league supervision where any finding would be kept secret—would be unjust to him.

Gruden would request a hearing before each of the Nevada Supreme Court’s seven judges, according to Hosmer-Henner.

“The split decision by the panel would leave Nevada as an anomaly where an employer can arbitrarily decide whether an employee’s dispute needs to be resolved through arbitration and can also decide to arbitrate the dispute itself,” Hosmer-Henner stated.

appeals that might or might not be filed, so even after this decision, things might change. Since the Raiders have moved on and are concentrated on what is happening under their roof, it is unlikely that they will become embroiled in any of this.
